THE CONTITUTIONAL GUARANTEE OF AMPARO IN LATIN AMERICA

Abstract:

Amparo or jurisdictional protection of rights is a joint institution of the part of most of Latin American countries. Amparo in the Americas, unlike Europe, presents a constitutional procedural character, because it turns out to be a real alternative process about what ordinary. For this reason it can leave without having to expect the eventual conclusion of the ongoing processes to achieve the protection of the fundamental right or constitutional prejudice or violated. This analysis of Amparo in the countries of Latin America comes as result of a research work to compare with the constitutional legal system of the country. The most important question of this research is whether constitutional review of the Constitution of the Republic of Albania or not to touch chapter of constitutional guarantees with the modifications necessary for the protection of citizens by adding ex novo certain rights - guarantee (such as amparo) in the Constitution of our country. The study and analysis of deeper performed by us with the countries of Latin America leads us to conclude that the Constitution of the Republic of Albania must at all costs be adapted models contemporary constitutional empowerment of rights and constitutional guarantees in protecting absolute individual.
